The regulation of exhibitions by means of cinematographs and the licensing of places in which cinematograph films are exhibited in the state of Karnataka are as per the provisions laid down in Karnataka Cinemas (Regulation) Rules, 2014 framed under Karnataka Cinemas (Regulation) Act, 1964.
The Karnataka Cinemas (Regulation) Act, 1964 was enacted by the state Legislature vide Notification-II No. HD 50 CAN 62, dated 6th March, 1971 Karnataka Gazette, Extraordinary, dated 10-03-1971 and has come into force on 15th day of March 1971.
In exercise of the powers conferred by section 19 of the Karnataka Cinemas (Regulation) Act, 1964, the Karnataka Cinemas (Regulation) Rules, 2014 has been formulated by the Govt. of Karnataka vide notification No. HD 12 CAN 2010 dated 7-10-2014 Karnataka Extraordinary Gazette No :635 (Part IV A) , dated 7-10-2014. The Karnataka Cinemas (Regulation) Rules, 1971 has been repealed.
The Deputy Commissioner exercising the powers of a District Magistrate or an Additional District Magistrate in every District is the Licensing authority having power to Grant licences for exhibition of cinematograph films under the Karnataka Cinemas (Regulation) Act, 1964.
Any person who intends to use any place for the exhibition of cinematograph films; or to use any site for constructing a building thereon for the exhibition of cinematograph films; or to construct or reconstruct any building for such exhibition; or to install any machinery in any place where cinematograph exhibitions are proposed to be given shall obtain a No Objection Certificate from the licencing authority.
After obtaining the No Objection certificate the applicant shall submit an application for approval of the plan of the building to be constructed on the approved site showing among other things the location and technical details of cinematographic equipments, complete electrical installation with all wiring, distribution meter-boards and other electric machinery to the Licensing Authority.
Thereafter the Licensing Authority shall simultaneously consult the Director and other local authorities concerned and also shall forward the records to the Electrical Inspector as the case may be to examine the designs pertaining to the cinematograph plant, the electrical installation and to forward a report to the Licencing authority whether the electrical installation are in accordance with the provisions of these rules relating to safety of electrical installation.
The Electrical fitness Certificate is granted by the Chief Electrical Inspector to Govt. & by the jurisdictional Officers for different types of Cinema theatres as per the delegation of powers given below.
